How SouthPay collects, uses, shares, and protects personal information when you visit our website, communicate with us, or use the SouthPay platform. This policy applies to the SouthPay website and the SouthPay platform operated by SouthPay LLC.
SouthPay is a software and payment orchestration platform operated by SouthPay LLC, a Wyoming limited liability company ("SouthPay", "we", "us", or "our"). This Privacy Policy explains how we handle personal information in connection with the SouthPay website at southpay.io and related subdomains, our marketing and sales communications, and the SouthPay platform.
For the purposes of the EU General Data Protection Regulation (GDPR) and the UK GDPR, SouthPay is the controller of the personal information described in this policy, except where this policy states that a third-party payment service provider acts as an independent controller (see Section 6).
If you are a merchant, this policy supplements the SouthPay Merchant Payment Services Agreement and the SouthPay AML Policy. In the event of any conflict between this policy and the Merchant Payment Services Agreement on the subject of data, this policy governs questions of personal information and the Merchant Payment Services Agreement governs the commercial relationship.
This policy covers:
This policy does not cover the data practices of third-party payment service providers ("PSPs"), the platforms on which you operate your store (such as Shopify or WooCommerce), or any other third-party website or service, even where we link to them. Those parties operate under their own privacy policies.
We do not knowingly collect personal information from end-user payers through the website. Where an end user pays a merchant through a SouthPay-generated checkout, any personal information involved in that payment is handled by the applicable PSP under its own policy.
We do not collect special categories of personal data (such as health, biometric, or political data) in the ordinary course, and we ask that you do not provide such data to us.

We use cookies and similar technologies to operate the website, remember your preferences, measure usage, and improve performance. Strictly necessary cookies are required for the website to function. We retain personal information for as long as necessary to provide the platform and to satisfy the purposes described in this policy. In line with our AML Policy, we retain records relating to merchant onboarding, transactions, sanctions screening, and compliance decisions for not less than five (5) years from the date of the relevant activity or the end of the merchant relationship, whichever is later, or for such longer period as applicable law requires. Where personal information is no longer required, we delete or anonymize it.
We maintain technical and organizational measures designed to protect personal information against unauthorized access, loss, misuse, and alteration, including access controls, encryption in transit, and segregation of duties. No method of transmission or storage is completely secure, and we cannot guarantee absolute security. You are responsible for keeping your account credentials confidential.
Depending on where you are located, you may have some or all of the following rights regarding your personal information:
